Illinois Public Construction Bonds

Illinois law requires bonds for certain public construction contracts.

Under the current Illinois Public Construction Bond Act, through December 31, 2028, many State or political-subdivision public works contracts costing more than:

$150,000

must require the contractor to provide a bond.

Special temporary thresholds currently apply to Illinois Department of Transportation and Illinois State Toll Highway Authority contracts.

Beginning January 1, 2029, the general statutory threshold is scheduled to return to:

$50,000

unless Illinois law is changed before then.

Local governments may also impose bond requirements on smaller projects by ordinance or resolution.
